Evidencing Compliance in Regulated Categories

In licensed categories the application is a compliance file. Without the evidence, there is nothing for an underwriter to review.

Compliance is the application

In conventional categories, compliance documentation supports a commercial assessment. In regulated categories it comes first: if the business cannot evidence that it is entitled to sell what it sells, where it sells it, there is nothing to assess.

This is why licensed-category applications move slowly when documentation is incomplete and comparatively smoothly when it is not.

Map the requirement to the jurisdiction

Requirements are jurisdictional, and a licence in one market says nothing about another. Before applying, write down for each market you sell into: what authorisation is required, whether you hold it, and what evidence you can produce.

  • Licences, registrations or notifications, with expiry dates
  • Product-level approvals or testing where the category requires them
  • Age-verification obligations and the method you use
  • Restrictions on where you may ship or provide service
  • Advertising and claims restrictions specific to the category
  • Record-keeping and reporting duties

Claims get read closely

In health, wellness, financial and credit-related categories, marketing language is frequently the thing that ends an application. Therapeutic claims, income claims and outcome guarantees attract regulatory attention, and underwriters know it.

Review not just your product pages but your ad creative, landing pages, affiliate content and influencer briefs. An underwriter checking your paid traffic will find the claim you forgot about.

Enforce restrictions technically

A policy statement that you do not sell into a restricted jurisdiction is not a control. Underwriters look for enforcement: geo-blocking, address validation, age gates that actually gate, and shipping rules configured in the platform.

The same applies to age verification. A self-declared checkbox is not equivalent to a verification service where the rules require one.

Keep the pack current

Licences expire, product lines change, and markets open and close. A compliance pack assembled once and never revisited becomes inaccurate quickly, and an out-of-date licence in an application is worse than none.

Maintain it as a living file with review dates. It shortens every future application and every provider review of an existing account.

A note on availability

Availability in regulated categories is subject to legality, licensing, jurisdiction, product type, marketing practices, bank policies, card-network rules, and full underwriting review. A complete compliance file makes an application reviewable; it does not make it approvable.
